One of the requirements of the Commissioner under the Transport (Scotland) 2005 Act is to produce an Annual Report outlining his objectives and how they have been met. The Commissioner is accountable to the Scottish Ministers and ultimately to the Scottish Parliament.
John Gooday, the Scottish Road Works Commissioner said:
"I am pleased to announce the publication of my second Annual Report."
"The data collection for the first set of statistical Indicators contained in the report only commenced on 1 October 2008 when the last of the new Scottish road works legislation came into force. The last six months of 2008-09 were seen as a bedding-in period for the roads authorities and utility companies to allow then to get to grips with the new legislative requirements."
"During this bedding-in period the early indications are that there have been improvements in some areas, such as the quality of the information which the utility companies provide. However, in other areas, such as the placing of notices by roads authorities, the indications are that the performance of some authorities has been poor. Also, although results show that the quality of utility company reinstatements have improved slightly, this is not the step change improvement which I wish to see."
"Now that the bedding-in period is over, I am using the Indicators for 2009-10 to formally monitor the performance of both roads authorities and utility companies operating in Scotland. Poorly performing organisations will be identified and asked to prepare improvement plans which will then be closely monitored. I do not propose to consider the use of penalties until organisations have been given an opportunity to improve. However, where organisations continue to perform poorly and show little sign of improvement, I will not shirk from applying appropriate penalties."
